Yearn's Regulation
The Yearn US Fund is classified as an investment fund and is a fund for joint account (fonds voor gemene rekening) established in accordance with Dutch law. The fund is a unique contractual arrangement between the fund manager, the legal owner, and each investor.
The fund manager is registered as a so-called ‘light’ manager under the AIFMD regime. The fund manager, therefore, does not fall under the supervision of the AFM and DNB and is exempted from requiring a license. To be eligible for this regime, the fund manager must exclusively offer units to investors with a minimum investment of one hundred thousand euros and manages (one or more) alternative investment funds with a total assets under management of less than or equal to one hundred million euros.
This registration type allows Van Druten Capital to start the Yearn US Fund without high regulatory costs, causing fund fees to stay competitive. Van Druten Capital has the intention to apply for the complete AIFMD regime in the future.
