In reality, the ‘𝙡𝙞𝙜𝙝𝙩’-𝙧𝙚𝙜𝙞𝙢𝙚 under the AIFMD entails a wide range of legal obligations. It simply means that fund managers operate under a 𝗿𝗲𝗴𝗶𝘀𝘁𝗿𝗮𝘁𝗶𝗼𝗻 𝗳𝗿𝗮𝗺𝗲𝘄𝗼𝗿𝗸 rather than a full AIFMD license, and are not 𝗮𝗰𝘁𝗶𝘃𝗲𝗹𝘆 supervised by the AFM. Certain checks, such as the formal appointment of a depositary and some governance layers, are exempted, but the fund is far from unregulated.
